These terms govern your use of pulptropolis.com and any purchase you make through it. The site is operated by Barry K Gregory DBA Pulptropolis Media, from Orlando, Florida, USA. By using the site you accept these terms. If you don’t accept them, please don’t use the site.
Who may use the site
You must be old enough to enter a binding contract where you live — in most places, 18. Our books may contain violence, profanity, and adult themes; they are written for adult readers.
Orders and payment
Adding an item to your cart is not a contract. Your order becomes binding when we accept it, which happens when we send a confirmation email. Until then we may decline any order for any lawful reason, including suspected fraud, a pricing error, or stock we no longer have.
Prices are in US dollars and exclude shipping unless stated. We may change prices at any time, but never after accepting your order.
If we have made an obvious pricing or description error, we may cancel the affected order and refund you in full rather than honour the mistake. We will tell you before doing so.
Signed editions
Books sold here as signed editions are signed by hand by the author. Signatures vary. Minor variation in placement, ink flow, and the way a spine settles is a property of a physical object touched by a person, not a defect.
Unless a listing says otherwise, signed editions are not personalised, numbered, or accompanied by a certificate.
Shipping
We ship on weekdays. Delivery estimates are estimates, not guarantees, and once a parcel is with the carrier its timing is out of our hands.
Risk of loss passes to you on delivery. If a parcel arrives damaged or fails to arrive at all, tell us — see our Refund Policy, which explains what we do about it.
You are responsible for any import duties, customs charges, or taxes levied by your own country.
Digital editions and the free ebook
When you receive an ebook from us — including the free one that comes with a newsletter subscription — you get a personal, non-exclusive, non-transferable licence to read it on devices you control. You may not:
- redistribute, upload, share, resell, or lend the file;
- strip or circumvent any rights-management applied to it;
- reproduce substantial extracts publicly without permission.
You may of course quote briefly in a review. That is what reviews are for, and we would be delighted.
Our content
Everything on this site — the fiction, the cover art, the essays in The Pulpit, the site design, the Pulptropolis name and logo — is owned by us or licensed to us, and is protected by copyright and trademark law.
You may read it, link to it, and quote short passages with attribution. You may not republish it, sell it, or present it as your own.
Text and data mining
We expressly reserve all rights in the content of this site for the purposes of text and data mining, machine learning, and the training or fine-tuning of artificial intelligence models. No licence for those uses is granted, whether by these terms, by the presence of the content on a public website, or by the absence of a technical block.
This reservation is intended to have effect under Article 4(3) of EU Directive 2019/790 and any equivalent provision elsewhere. Automated collection of this site’s content for those purposes is not permitted.
Things you must not do
- Scrape, crawl, or harvest the site beyond ordinary search-engine indexing.
- Attempt to gain access to any account, server, or system you are not authorised to reach.
- Interfere with the site’s operation, or introduce malicious code.
- Use the site to send unsolicited commercial messages.
- Misrepresent your identity or affiliation with us.
The newsletter
Subscribing to The Dispatch is voluntary and free, and includes a free ebook. We send it roughly weekly. You can unsubscribe from any issue with one click, and we will stop. We do not sell or rent the list.
Unsolicited submissions
We are not open to submissions and do not accept unsolicited manuscripts, pitches, proposals, or guest posts. Anything sent to us unsolicited will be deleted unread, and we accept no obligation of confidentiality and no liability in relation to it.
If you send us an idea anyway, you understand and agree we may incidentally develop — and are free to do so — work that resembles it, and that we owe you nothing for doing so. Independent creation happens constantly — that is why we don’t read submissions.
Links to other sites
We link out to retailers, including Amazon, and sometimes to other people’s writing. We don’t control those sites and aren’t responsible for their content, their terms, or their privacy practices. When you buy from another retailer, your contract is with them.
Disclaimers
The site is provided “as is”. We work to keep it accurate and available, but we don’t warrant that it will be uninterrupted, error-free, or free of anything harmful. Content in The Pulpit is the opinion of one person and commentary on writing craft and other things — it is not professional advice and should never be construed as such.
Limitation of liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost data, arising from your use of the site.
Where liability cannot be excluded, our total liability to you is limited to the amount you paid us in the twelve months before the claim arose, or twenty-five US dollars, whichever is greater.
Nothing here excludes liability for fraud, for death or personal injury caused by negligence, or for anything else that cannot lawfully be excluded. Some jurisdictions do not allow certain exclusions, in which case the exclusion applies only as far as permitted.
Indemnity
If your misuse of the site causes a third-party claim against us, you agree to cover our reasonable costs in dealing with it.
Governing law
These terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts serving Orange County, Florida, and you consent to that venue.
If you are a consumer resident elsewhere, this does not remove any right you have to bring proceedings in your own country where local law guarantees it.
Severability
If any part of these terms is found unenforceable, the rest continues to apply.
Changes
We may update these terms. The date at the top will change when we do. Continuing to use the site after a change means you accept the revised terms; the terms in force when you placed an order continue to govern that order.
